These Terms and Conditions (“Terms”) apply to roguearsenal.com and to purchases from Rogue Arsenal LLC (“Rogue Arsenal,” “we,” “us,” or “our”). By using the website, placing an order, checking the required checkout acknowledgments, or purchasing our products, you agree to these Terms.
Important: Rogue Arsenal products are inherently hazardous. Read all warnings, instructions, safety guidelines, waiver terms, and product information before purchasing or using any product.
1. Adult Use Only
You must be at least 18 years old and legally permitted to purchase, possess, transport, store, and use Rogue Arsenal products. By placing an order, you represent that you meet these requirements.
2. Product Purpose
Rogue Arsenal products, including the Blank Firing Distraction Device (“BFDD”) and Specialty Blank Munitions, are designed for lawful training, signaling, and professional use only. They are inherently hazardous and must be used only as directed, in a safe and lawful environment, with proper training and protective equipment.
3. Order Approval Required
All orders are subject to review and approval before shipment. We may refuse, cancel, hold, or refund any order at our discretion, including where we cannot confirm required waiver completion, legal eligibility, payment validity, shipping eligibility, or safe and lawful intended use.
4. Required Waiver
Certain products require a signed Rogue Arsenal Liability Waiver and Release Agreement before shipment. By placing an order, you acknowledge that shipment may be delayed or withheld until the required waiver is completed and accepted. If you do not complete the required waiver, Rogue Arsenal may cancel and refund the order, subject to any lawful deductions or processing limitations.
The waiver is incorporated into these Terms by reference for products that require it.
5. Safety Acknowledgments
By purchasing or using Rogue Arsenal products, you acknowledge and agree that:
- The products are inherently dangerous and can cause serious injury, burns, hearing loss, blindness, disfigurement, death, and property damage.
- You are responsible for reading and following all instructions, warnings, and safety guidelines.
- You must use appropriate eye and hearing protection.
- You must keep vent ports and discharge areas away from your body and away from others.
- You must not use products near flammable materials.
- You must use the safety pin when loading blanks and remove it only immediately before deployment.
- You must use only Rogue Arsenal approved blanks with the BFDD.
- You are solely responsible for safe storage, handling, transportation, and lawful use.
6. Compliance With Laws
You are solely responsible for knowing and complying with all federal, state, and local laws and regulations that apply to your purchase, possession, transportation, storage, resale, transfer, and use of Rogue Arsenal products.
By placing an order, you represent that you are not legally prohibited from purchasing, possessing, or using the ordered products and that you will not use the products for any unlawful purpose.
7. Export and Restricted Transfers
Rogue Arsenal products may not be exported outside the United States or transferred to any person or entity you know or have reason to believe intends to export them outside the United States, unless all required legal authorizations have been obtained. Rogue Arsenal currently ships only within the 48 contiguous United States.
8. Product Information
We try to provide accurate product descriptions, pricing, and availability. We may correct errors, cancel orders affected by errors, and update product information at any time.
9. Shipping
Rogue Arsenal products ship by UPS Ground, FedEx Ground, or another carrier selected by us. Shipping is available only to eligible addresses in the 48 contiguous United States. Shipping times are estimates only and may be affected by order approval, waiver completion, inventory, carrier delays, weather, or other circumstances.
10. Returns, Refunds, and Exchanges
Due to the nature of the products, all sales are final except for verified manufacturing defects as determined by Rogue Arsenal. See our Shipping and Return Policy for more information.
11. No Warranties
To the maximum extent allowed by law, Rogue Arsenal products are sold “as is” and “with all faults.” Rogue Arsenal disclaims all express and implied warranties, including implied warranties of merchantability and fitness for a particular purpose, except where a disclaimer is prohibited by law.
12. Limitation of Liability
To the maximum extent allowed by law, Rogue Arsenal LLC and its owners, members, officers, employees, agents, representatives, distributors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the website, products, purchase, possession, storage, transportation, handling, use, misuse, resale, or transfer of products.
Nothing in these Terms is intended to limit liability in a way that is prohibited by applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Rogue Arsenal LLC and its owners, members, officers, employees, agents, representatives, distributors, and affiliates from claims, liabilities, damages, judgments, costs, and expenses arising from or related to your purchase, possession, storage, transportation, handling, use, misuse, resale, transfer, or violation of these Terms or applicable law.
14. Website Use
You may not misuse the website, attempt unauthorized access, interfere with checkout or payment systems, submit false information, or use the website for any unlawful purpose.
15. Intellectual Property
All website content, product names, designs, text, images, graphics, logos, and other materials are owned by Rogue Arsenal or its licensors and may not be copied, reproduced, or used without permission.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Texas. Any dispute arising from or relating to these Terms, the website, or purchases from Rogue Arsenal shall be brought in the state or federal courts located in Travis County, Texas, unless applicable law requires otherwise.
17. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date.
